COOKIES POLICY

This Cookies Policy explains how the Moment.md platform uses cookies and similar technologies, the purposes for which they are used, the applicable legal basis, and how users may manage their preferences.

Cookies are small text files that are stored on a user's device when visiting a website. They may enable the technical operation of the platform, remember user preferences, analyze use of the service or, where necessary, provide additional functionality.

  • strictly necessary cookies — necessary for the technical functioning of the website, authentication, security, session balancing and the retention of basic settings;
  • functional cookies — used to remember user preferences, including language and display settings;
  • analytical cookies — used to understand how the platform is used and to improve its performance, structure and user experience;
  • marketing cookies or similar technologies — used only if implemented and exclusively after obtaining the user's valid consent.

Strictly necessary cookies are used to the extent that they are necessary to provide the requested service and ensure the secure operation of the platform.

Cookies that are not strictly necessary, including analytical and marketing cookies, are used only after obtaining the user's consent in accordance with Article 6(1)(a) and Article 7 of Law No. 195/2024: consent must be freely given, specific, informed and unambiguous, and the Operator must be able to demonstrate that it was obtained.

To the extent that the use of strictly necessary cookies involves the processing of personal data, such processing is carried out on an appropriate legal basis provided for by Article 6 of Law No. 195/2024, in particular where it is necessary for the performance of a contract/pre-contractual steps or for the Operator's legitimate interest in ensuring the security and technical functioning of the Platform.

Upon the user's first visit to the platform and, where necessary, the user is shown a banner or preference centre where they can accept, reject or configure cookie categories.

Refusal of non-essential cookies must not restrict access to the platform's core functions, except where certain functions are technically dependent on such cookies.

The user may change their settings or withdraw consent at any time, with effect for the future, through the website settings.

Consent is requested separately from other terms and conditions, without pre-ticked options, and withdrawing consent must be as easy as giving it; withdrawal does not affect the lawfulness of processing carried out before the withdrawal.

The Platform publishes or makes available through the preference centre an up-to-date list of the cookies used, their retention period, their type (first-party or third-party), and, where necessary, information about external providers.

Where third-party providers are used for analytics, payments, security or other functions, the user will be informed of their role to the extent necessary for transparency.

If a third-party provider processes personal data, the user is provided with information about the recipient or categories of recipients and, where data are transferred outside the Republic of Moldova, about the applicable transfer mechanism and safeguards in accordance with Chapter V of Law No. 195/2024.

If information collected through cookies allows a person to be directly or indirectly identified, it is considered personal data and is processed in accordance with the Platform's Privacy Policy, Law of the Republic of Moldova No. 195/2024 “On the Protection of Personal Data” and other applicable legislation.

The Operator may retain records of the user's consent, changes to preferences and withdrawal of consent for compliance and evidentiary purposes.

Records of consent and changes to preferences are retained only for the period necessary to demonstrate compliance with legal requirements, in accordance with the principles of data minimisation and storage limitation.

In addition to the preference centre on the website, the user may manage cookies through the browser settings. Blocking strictly necessary cookies may affect the operation of certain platform functions.

This Policy may be updated periodically due to changes in legislation, technologies or commercial conditions. The updated version is published on the website and enters into force upon publication, unless otherwise provided by law.
